Know before you build
Hamilton's wetlands bylaw sets two lines.
Hamilton's own bylaw is stricter than the state act, with a no-disturbance zone and a no-build zone that depend on when your lot was created.
Older house lots: 25 and 50 feet
On residential lots occupied or permitted by the end of 2007, there's a 25-foot no-disturbance zone and a no-build zone out to 50 feet from a wetland.

In other cases the no-disturbance zone is 50 feet and the no-build zone runs to 75. Around vernal pools, the whole 100 feet is no-disturb.

The no-disturbance zone allows no construction or vegetation removal, and not even dumping leaves or clippings. The no-build zone bars anything that needs a building permit, but driveways and fences may be allowed.

From May to September, sprinklers and irrigation systems on town water can't run from 8 AM to 8 PM, and irrigation systems need rain sensors. When the Ipswich River runs low, the town can ban sprinklers entirely, including on private wells.

The Hamilton Historic District on Bay Road reviews changes visible from a public way. The current handbook exempts walls, fences and at-grade walks and terraces, though the Commission has proposed reviewing walls and fences. Check before you build.

How close to a wetland can I build a patio in Hamilton?
It depends on when your lot was created. Older house lots have a no-build zone out to 50 feet, other lots out to 75. Anything needing a building permit can't go in that zone.
Can a fence go near a wetland in Hamilton?
The no-build zone bars anything needing a building permit, but the bylaw says fences and driveways may be allowed. We'll check with the Commission.
Can I water my new lawn during the day?
Not with sprinklers from May to September: they're banned from 8 AM to 8 PM on town water. Early morning or evening watering is the plan.
